Cannot remember if it was just a faulty installation or a mod though that caused it...

Try turn all mods off and see if that helps, if it does, then it IS a mod. Else it's time to reinstall Oblivion.

Personally I've used the music from both Warlords 2 Deluxe and Warlords 2 Dark Lords Rising with some success.
But it's not really appropriate for battle, it's way better for either public or exploration.
